These Terms and Conditions govern your use of the Nomenco naming tool operated by Aberlay, a company registered in France. By purchasing or using Nomenco, you agree to these terms in full.

1. Service description

Nomenco is a methodology-driven naming tool for startup founders. It generates company name candidates, verifies .com domain availability, and provides brand direction for each name. The service is delivered as a web application accessible via a time-limited access token.

2. Pricing and payment

Nomenco is priced at $1,900 USD as a one-time payment. Payment is processed securely through Stripe. You receive access to a single naming project upon successful payment.

Refund policy

You may request a full refund within 7 days of purchase, provided you have not exported any naming results from the tool. Once you export results (names, brand directions, or any generated output), the refund window closes. Refund requests should be sent via LinkedIn.

3. Access and account terms

Upon purchase, you receive a unique access token delivered by email. This token is valid for 30 days from the date of issuance. After 30 days, the token expires and you will no longer be able to access your project. If you need extended access, contact us before the token expires.

Your access token is personal. Do not share it. We are not responsible for unauthorized access resulting from a shared or compromised token.

4. Intellectual property

Your names

All company names generated through Nomenco belong to you. We claim no ownership, license, or residual rights over names you generate, export, or register. You are free to use, trademark, or commercialize any name produced by the tool.

Our tool

The Nomenco software, methodology, interface, and underlying technology remain the intellectual property of Aberlay. You may not copy, reverse engineer, or redistribute any part of the tool.

5. Limitation of liability

Nomenco checks .com domain availability at the time of generation. We do not guarantee that a domain will remain available at the time you attempt to register it. Domain availability is checked in real time but can change at any moment.

Nomenco does not provide legal advice. The tool does not perform trademark searches, trademark clearance, or any form of legal review. It is your responsibility to conduct proper trademark due diligence before adopting any name. We strongly recommend consulting a trademark attorney before registering or using a generated name commercially.

To the maximum extent permitted by applicable law, Aberlay's total liability for any claim arising from or related to the use of Nomenco is limited to the amount you paid for the service ($1,900 USD). Aberlay is not liable for any indirect, incidental, consequential, or punitive damages.

6. Acceptable use

You agree not to use Nomenco to generate names for illegal purposes, to attempt to overwhelm or abuse the service, or to interfere with its operation. We reserve the right to terminate access for any user who violates these terms.

7. Changes to these terms

We may update these terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the service after changes constitutes acceptance of the updated terms.

8. Governing law and jurisdiction

These terms are governed by the laws of France. Any disputes arising from or relating to these terms or your use of Nomenco will be subject to the exclusive jurisdiction of the courts of Grasse, France.
